Damaged Merchandise
Occasionally a fitness product may
be damaged in the shipping process. This may be true even though the exterior
of the box may show no damage (placement of a heavier item on your bike may
cause fenders and light frames to twist or bend). Damaged shipments must be
filed with the carrier. We cannot be responsible for damage caused in the shipping
process. Purchasers will be responsible for shipping costs associated with damaged
part replacements. If you have any question regarding this issue, please feel
free to contact us. We will be glad to help you.
For a small fee Fitness Central
will provide our "sleep tight" program, which will assure that your
bike, is insured up to $200.00.
If you take out the additional
insurance under the sleep tight program your fitness product will be insured up to
$200.00. This insurance claim will be assigned to you allowing you to file a
claim with the carrier and
receive directly the proceeds of such insurance. Fitness Central will assist you
in the claim process but will
not otherwise be responsible for shipping damage.
Manufactures Defects
If a product appears to have a manufactures defect, please email us the details
along with JPG or GIF pic's. We will respond within 3 days advising you what
action the manufacture desires to take. Do not return Items to us without receiving
instructions. The manufacture must approve the return of the item where any
claim of manufacture defect is made. If an item is to be returned due to manufactures
defect, you must first receive a Return Authorization Number. No packages will
be accepted without a Return Authorization Number written clearly on the box.
The purchaser is responsible for the shipping costs associated with any returned
item. Fitness Central is not responsible for manufacture defects. We will be glad
to facilitate your claim with the manufacture but
manufacture defects are the responsibility of the manufacture. As such, you
agree to indemnify Fitness Central from any such claims.
Return Merchandise
Policy
We have the most straightforward return policy possible: Returns only where
shipping or manufactures defects as set forth in the return policy. Because
our fitness products cannot be re-sold as new once they have been shipped to you or
re-sold once you have put the bike together we don't offer a return or refund.
However, if you want to exchange your fitness product for another fitness product we will entertain
such on a case by case basis understanding that you will be responsible for
shipping and pay a 30% restocking fee. The fitness product being exchanged must be returned
within 10 days and with all unused original packaging and literature materials.
Permission for any return merchandise must be secured from our return department.
This does not apply to fitness products damaged in shipping or having manufactured defects,
which have their own remedy. No packages will be accepted without a Return Authorization
Number written on the box.
Please note that bikes,
which are on sale and special promotion fitness products, are not refundable or exchangable.
No exception.
- Return the item to the
address given to you by our RMA department.
- Write the RMA number
(Return Merchandise Authorization Number) on the box.
- Keep your shipping records
for proof of shipment in the event of loss of returned merchandise. Returns
shipped via U.S. Postal Service (U.S.P.S.) or with a value of over $100.00
should be insured. We are not liable for return merchandise that does not
reach our return department.
- We will notify you via
e-mail of your refund once we have received and processed the returned item.
You can expect a refund in the same form of payment originally used for purchase
within 14 to 21 business days of our receiving your return. Please note that
shipping charges are not refundable.
Please make your selection
carefully. Cancellations are only allowed with a 30% cancellation penalty/fee.
Manufactures Warranty
1. Three months for the
frame and one month all component joint parts.
2. The manufacture will replace any parts failing during the warranty period.
The shipping fee will not be covered by the warranty.
3. Unless otherwise provided, the sole remedy under the above warranty or any
implied warranty is limited to the replacement of defective parts with those
of equal or greater value at the sole discretion of the manufacture. You will
be responsible for labor and shipping costs associated with warranty replacements.
Items
not covered by warranty
1. Gear or brake adjustments.
2. Any alteration made or aftermarket part installed on bike by customer.
3. Wear and tear to bike, tires or components.
4. Damage as a result of any bike accident
5. Damage attributable to shipping damage
Sales Tax
1. Sales Tax is charged
on all sales made to Texas residents or where the item is shipped to Texas.
2. "Texas sales tax
residents pay 8.25% sales tax on the total price and you hereby authorize us
to charge or re-charge your credit card for such tax"
3. The sales tax rate is
subject to change at any time.
International
Shipping
At this time we ship only to Canada and the lower 48 U.S. states.
Legal Stuff
If any product is subject to federal or state consumer warranty laws, our statement
of limited warranty included with the product applies in place of these warranties.
Misuse, accident, modification, unsuitable physical or operating environment,
improper maintenance by you or failure caused by an item for which we are not
responsible may void these warranties. This warranty replaces any other warranty,
express or implied, including the implied warranties of merchantability and
fitness for a particular purpose.
If you do not understand
any of the terms of this Limitation of Warranty and Liability or their implications,
please consult an attorney. This limitation on warranty and liability IS PART
OF THE TERMS OF SALE, CONSTITUTES A BINDING AGREEMENT, AND MAY BE ENFORCED AGAINST
YOU.
In addition, Purchaser agrees
that the total of any and all liability, regardless of fault, shall be limited
to the total of your fitness product purchase with Colton Enterprises or $200.00 whichever
is greater.
Under no circumstances are
we liable for third-party claims against you for losses or damages; loss of
or damage to your records or data; or consequential damages (including lost
profits or savings) or incidental damages, even if we have been advised of the
possibility of such damages.
The laws of the State of Texas shall govern this agreement. The parties hereby
agree that any dispute relating to the Products sold hereunder shall be subject
to the jurisdiction and venue of the Courts of Dallas, Texas, and the parties
hereby consent to such jurisdiction and venue.
